0. Definitions

• SapphireMC ("Sapphire"): Refers to the community-driven Minecraft server operated by the SapphireMC team.
• User: Any person accessing or using Sapphire.
• TOS: These Terms of Service.

1. Acceptance of Terms

By accessing or using Sapphire (the "Server"), you agree to be bound by these Terms of Service ("TOS"). If you do not agree with any part of these terms, please do not use the Server.

2. Eligibility

You must be at least 13 years old (or the applicable age in your jurisdiction) to use Sapphire. If you are under the required age, you must have your parent or legal guardian's consent to access and use Sapphire.

3. Description of the Service

Sapphire is a community-driven Minecraft server that offers players a unique gameplay experience within the Minecraft universe. Please note that Sapphire is not affiliated with, endorsed by, or supported by Mojang, Microsoft, or any other related party. Use of the Server is also subject to compliance with Minecraft's End User License Agreement (EULA) and any other applicable Minecraft policies.

4. User Conduct and Responsibilities

• Respect and Community: All players are expected to interact respectfully. Harassment, hate speech, bullying, or any form of discriminatory behavior is strictly prohibited.
• Content Guidelines: Do not post or share content that is illegal, offensive, or violates the rights of others.
• Modifications and Plugins: While the use of mods that comply with Minecraft's EULA is permitted, any modifications, plugins, or exploits that provide unfair advantages, disrupt gameplay, or harm the Server environment are forbidden.
• Fair Play: Cheating, exploiting, or otherwise engaging in behavior that undermines the integrity of gameplay is grounds for disciplinary action, including possible suspension or termination of your access.

5. Intellectual Property

• Minecraft Intellectual Property: Minecraft, including all its assets and intellectual property rights, is owned by Mojang and Microsoft. Your use of Sapphire is subject to the permissions granted under the Minecraft EULA.
• Sapphire Content: All custom content provided by Sapphire—including maps, plugins, and other server-specific modifications—is the property of the Server administrators. Unauthorized use, reproduction, or distribution is prohibited.
• User-Generated Content: Content you create and share on Sapphire remains your property. However, by posting on the Server, you grant Sapphire a non-exclusive, worldwide, royalty-free license to use, display, and modify your content solely for the purpose of operating and promoting the Server.

6. Disclaimers and Limitation of Liability

• No Warranty: Sapphire is provided on an "as is" and "as available" basis. We do not guarantee that the Server will be available at all times or free of errors.
• Limitation of Liability: In no event shall Sapphire or its administrators be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of or inability to use the Server.
• Third-Party Content: The Server may include links to third-party websites or services. Sapphire is not responsible for the content or practices of these external sites.

7. Termination

Sapphire reserves the right to suspend or terminate your access to the Server at any time, for any reason—including, but not limited to, violations of these TOS or behavior that jeopardizes the safety and enjoyment of the community. Upon termination, your right to use the Server will immediately cease.

8. Privacy

Your use of Sapphire is subject to our Privacy Policy, which outlines how we collect, use, and protect your personal information. Please review the Privacy Policy carefully.

9. Changes to These Terms

Sapphire reserves the right to modify these TOS at any time. Any changes will be posted on the Server and will become effective immediately upon posting. Your continued use of the Server after any such changes constitutes your acceptance of the new terms.

10. Governing Law

These TOS shall be governed by and construed in accordance with the laws of the jurisdiction in which Sapphire operates, without regard to its conflict of law principles.

12. Refund Policy and Server Closure Disclaimer

• Refunds: All purchases made in connection with Sapphire—including any in-game items, subscriptions, or other paid services—are final and non-refundable. By making a purchase, you acknowledge and agree that no refunds will be provided under any circumstances.
• Server Closure: Sapphire is provided on an "as is" basis. In the event that the Server is permanently closed, Sapphire and its administrators shall not be held responsible for any loss of funds, access to purchased items, or any other consequences arising from such closure.

13. Indemnification

You agree to indemnify, defend, and hold harmless Sapphire, its administrators, and affiliates from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with your access to or use of the Server, your violation of these TOS, or your infringement of any intellectual property or other rights of any person or entity.

14. Severability

If any provision of these TOS is found to be unenforceable or invalid under any applicable law, such invalidity shall not render these TOS unenforceable or invalid as a whole. All other provisions shall remain in full force and effect.

15. Maintenance and Downtime Disclaimer

Sapphire may undergo scheduled maintenance or experience unexpected downtime. While we strive to provide advance notice where possible, Sapphire shall not be liable for any inconvenience, loss of access, or other issues arising from maintenance or downtime.

16. Ban Appeals / Moderation Process

If you believe that a suspension or ban was issued in error, you may appeal the decision on our official Discord server at discord.gg/sapphiremc. Please provide any relevant details or evidence to support your appeal. While we will review each case, all final decisions regarding bans and suspensions rest with the Sapphire administrators.

17. Force Majeure

Sapphire shall not be liable for any delay or failure to perform its obligations under these TOS due to events beyond its reasonable control, including (but not limited to) natural disasters, acts of government, war, terrorism, or other unforeseeable events.

18. Dispute Resolution / Arbitration

Any disputes arising out of or relating to these TOS or your use of the Server shall be resolved through binding arbitration in the jurisdiction where Sapphire operates, rather than in court. The arbitration process shall be conducted in accordance with the rules of the applicable arbitration association, and the arbitrator's decision shall be final and binding on all parties.
